Welcome to Chiabee! These Terms of Service (“Terms”) govern your use of our website, services, and products. By accessing or using our website and services, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree with these Terms, do not use our website or services.

1. Acceptance of Terms

By using our website and placing orders, you acknowledge and agree to these Terms of Service. Chiabee reserves the right to update or modify these Terms at any time without prior notice. Your continued use of our website after such changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use our services. By using our website, you represent and warrant that you meet this age requirement.

3. Our Services

Chiabee provides food and beverage products, including coffee, snacks, and other related items (collectively, “Products”). We offer these Products through our website, and you may either pick up your order at our location or use the Grab platform for delivery. We reserve the right to modify or discontinue any aspect of our services at any time without prior notice.

4. Ordering and Payments

When placing an order on our website, you agree to provide accurate, current, and complete information for the successful processing of your order. Payments must be made through the available methods on our website. Prices for Products may be updated without prior notice, but any changes will not affect orders that have already been confirmed.

5. Points and Rewards System

Chiabee offers a rewards system that allows you to earn points for every eligible purchase. The following terms apply to the Points and Rewards System:

  • Earning Points: Customers earn 0.0204 points for every ₱1 spent on eligible purchases.

  • Redeeming Points: Points can be redeemed for discounts on future orders. For example, 245 points = ₱5 off.

  • Points Expiration: Points expire 12 months after they are earned.

  • Non-Transferable: Points are non-transferable and cannot be exchanged for cash or any other form of monetary value.

  • Exclusions: Points cannot be earned or redeemed on gift cards, shipping fees, taxes, or through third-party platforms such as Grab.

  • No Monetary Value: Points have no real monetary value and are intended solely for promotional purposes. Chiabee does not recognize Points as currency, and Points cannot be redeemed for cash or used to purchase cash equivalents.

Impact on Refunds:

  • Refunds and Points: If you receive a refund for an order, the points earned from that purchase will be deducted from your account.

  • Using Points for Orders: Points applied to an order are non-refundable. If an order is refunded, the points used will not be reinstated.

6. Delivery and Pick-Up

We offer pick-up orders through our website and in-store for immediate preparation. For delivery, we partner with Grab. Please note the following:

  • Third-Party Delivery: We are not responsible for any delivery delays or issues arising from third-party delivery services.

  • Points Exclusion: Points are not awarded for orders placed via Grab delivery.

7. Refund and Returns Policy

8. Cancellations

Once an order has been confirmed, it cannot be canceled. If you need to change or cancel an order, please contact us immediately before the order is processed. We will do our best to accommodate changes but cannot guarantee any cancellations after the order is placed.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Chiabee and its affiliates, officers, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the website;
  • Any conduct or content of any third party on the website;
  • Any content obtained from the website;
  • Unauthorized access, use, or alteration of your transmissions or content.

10. Indemnification

You agree to defend, indemnify, and hold harmless Chiabee and its affiliates, officers, directors, employees, agents, suppliers, or licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the website, including, but not limited to, any use of the website’s content, services, and products other than as expressly authorized in these Terms.

11. Disclaimer of Warranties

Your use of the website and services is at your sole risk. The website and services are provided on an “AS IS” and “AS AVAILABLE” basis. Chiabee expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance.

  • Distributing harmful software or engaging in fraudulent activity;

Any disputes arising out of or related to these Terms or your use of the website and services shall be resolved through binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The arbitration shall be conducted in the Philippines, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect.
